Introduction

Burswood Limited (ABN 36 075 071 537), together with its wholly owned subsidiaries ("Burswood") operates in the tourism and leisure industry and, as a Group, has the overriding objective of providing a world-class gaming, entertainment and hospitality experience.

The collection and use of personal information assists Burswood in providing the highest level of service for which it has become renowned.

We respect the privacy of the personal information we collect and are committed to managing that information in a responsible manner.

Burswood is a member of the Australian Casino Association ("ACA") and has agreed to be bound by the provisions of the ACA Privacy Code (the Code is in draft form and is subject to the approval of the Privacy Commissioner). We also comply with the National Privacy Principles under the Privacy Act (as amended). This policy statement summarises how Burswood adheres to the Code.





1. Collection of Personal Information

Burswood only collects personal information which is necessary for the proper conduct of its operations. The level of personal information we collect varies and depends on the purposes for which we require the information.

We take reasonable steps to ensure that if we collect personal information from you, you will be advised of the purpose for which we collect the information and you have the right to access any information held about you.





2. Use and Disclosure of Personal Information

Burswood uses personal information only for the primary purpose for which it is collected or for a related purpose where you would reasonably expect the information to be used, such as for promotions. In some instances, information will only be used for the primary purpose and for no other purpose. You have the right to request that your information not be used for related purposes.

Accordingly, with promotional and other such material forwarded to you, you are provided with the opportunity to advise us you no longer wish to receive that type of material.

While we will not use personal information for any other purpose without your consent, we reserve the right to use the information in circumstances relating to the public interest. These circumstances may be related to:

  • a legal demand for the information from a law enforcement agency;
  • a public or individual health and safety issue; or
  • the protection of Burswood's rights and property, including, the protection of the integrity of the operation of the Burswood Casino.
Burswood does not share your personal information with other companies outside the Burswood Group, except where it has contractual arrangements for the provision of services, such as mail outs, with third party suppliers which may need access to this information to provide the relevant service. However, we require these suppliers to adhere to the principles of the Privacy Act and to strict conditions governing how your personal information may be used

We do not sell your personal information to third parties for their marketing purposes.





3. Quality of Personal Information

Burswood's policies and procedures aim to ensure that the personal information it holds is accurate, complete and up-to-date. In most instances, we rely on the correctness of information you provide. We, therefore, encourage you to advise us of any changes to that information.





4. Security of Personal Information

We take reasonable steps to protect the personal information we hold from misuse, loss and unauthorised access, and to destroy personal information we no longer require, unless we are otherwise required by law to keep it. We operate under policies and procedures which ensure that personal information is stored securely and is accessible only to employees who require access to the information to perform their duties.

Burswood employees are obligated not to disclose any information about Burswood's businesses (including the personal information it collects) to third parties without appropriate authorisation.





5. Openness

Burswood's policy on its management of personal information, including as set out in this document, is available to anyone who asks for it. We will take reasonable steps to respond to any general request with respect to the type of personal information we hold, for what purposes, and how we collect, hold, use and disclose that information.





6. Access to and Correction of Personal Information

You may request access to all personal information which we may hold about you. However, while we will accommodate these requests, we reserve the right to withhold this information under certain circumstances, such as, if:

  • providing access would pose a serious or imminent threat to the life or health of any individual;
  • providing access would have an unreasonable impact upon the privacy of other individuals;
  • the request for access is frivolous or vexatious; or
  • providing access would be unlawful, would prejudice any legal investigations, or would compromise the integrity of the operation of the Burswood Casino.
The release by Burswood of personal information related to the operation of the Burswood Casino is also subject to the authorisation of the Chief Casino Officer under the Western Australian Gaming Commission Act 1987 and Casino Control Act 1984.

Should you wish to access your personal information, you may direct your request to the Club Burswood Desk in the Casino.

You will be required to provide suitable identification to enable us to protect the security and privacy of your personal information. In circumstances where accessing the information is resource intensive, we reserve the right to charge an administration fee for the retrieval of this information.

Our objective is to ensure your personal information is accurate and up-to-date. To assist us in this regard, you may also advise us of any changes to your information by providing your details to the Club Burswood Desk in the Casino. In this event, you will also be asked to provide suitable identification when providing these changes.





7. Identifiers

An identifier is a number assigned by an organisation to an individual to identify uniquely the individual for the purposes of the organisation's operations.

Burswood does not adopt, use or disclose an identifier that has been assigned by a Commonwealth government 'agency'.





8. Anonymity

With many of the services we provide, you may choose not to provide personal information. However, we do have operational and legal obligations to collect personal information for some types of transactions and activities. If you do not provide the required personal information, you may not be able to participate in, and enjoy the benefits of, these activities.





9. Transborder (Overseas) Information Flow

Burswood does not disclose personal information to any person or organisation in a foreign country, if that country does not have a comparable information privacy scheme, except:

  • to Burswood personnel in Burswood's overseas offices when the information is required for operational reasons;
  • where you consent to the disclosure; or
  • if obtaining your consent is impracticable and Burswood considers that the disclosure is for your benefit and that you would have consented to the disclosure.





10. Sensitive information

Burswood does not collect sensitive information such as details about religion or ethnic origin, unless:

  • you have consented; or
  • it is required by law; or
  • it relates to the provision of a health service; or
  • it relates to individual or public health or safety.





11. Surveillance

Burswood is committed to providing a secure environment for all visitors and to maintaining the integrity of the operation of the Burswood Entertainment Complex. Our premises and their surroundings are under constant surveillance and information may be collected and used to prevent suspected illegal and undesirable activities. Signage is located at each entry to the Complex facilities notifying casino patrons of surveillance.





12. Cookies

When you visit our web site, we may use an Internet browser feature called a "cookie". A cookie is a small data file that may be placed on the computer of a web user (usually in the browser software folder) the first time a computer visits a web site which operates cookies. Cookies by themselves cannot be used to identify you personally. They only identify your computer when you visit our site. The information that we gain by using cookies provides us with statistics which can be used to analyse and improve our web site, products and services. If you do not wish to receive any cookies you can set your browser to refuse cookies. However, this may mean you are not able to take full advantage of our services.





Changes in the Future

We reserve the right to change our Privacy Policy at any time. All changes will be notified by posting an updated version of the Privacy Policy on our web site at www.burswood.com.au. Any changes to our privacy policy shall be deemed to take place on the date the changes are posted on our web site.
